These Terms of Service ("Terms") constitute a legally binding agreement between you and FarBeyondGifted LLC ("Company," "we," "our," or "us"). By accessing our website, enrolling in our services, or communicating with us via SMS/text messaging, you agree to be bound by these Terms and our Privacy Policy.

4. ELIGIBILITY AND REGISTRATION

4.1 Age Requirements

Participants under 18 years of age must have verifiable parental or guardian consent before enrolling in any services. Parents/guardians are responsible for ensuring their minor child's compliance with these Terms.

4.2 Health and Safety Requirements

All participants must be physically capable of participating in athletic activities. You must disclose any medical conditions, injuries, or limitations that may affect participation. We reserve the right to require medical clearance before participation.

5. PAYMENT TERMS AND POLICIES

5.1 Payment Methods

We accept payments through our secure online payment system. All payments must be made in advance of services unless otherwise agreed in writing.

5.2 Pricing and Fees

• All prices are subject to change with 30 days' notice
• Monthly subscriptions automatically renew unless cancelled 48 hours before renewal
• Day passes and single sessions are non-refundable after purchase
• Package deals are non-transferable between participants

5.3 Refund Policy

We offer a 30-day money-back guarantee for monthly subscriptions. Refunds are prorated based on unused sessions. Day passes and completed services are non-refundable. Refund requests must be submitted in writing to +1(347)644-4416.

6. SMS/TEXT MESSAGING TERMS (A2P COMPLIANCE)

6.1 Consent to Receive Messages

By providing your mobile phone number, you expressly consent to receive SMS/text messages from FarBeyondGifted LLC regarding:

• Training session reminders and schedule changes
• Payment confirmations and billing notifications
• Important safety and emergency communications
• Promotional offers and marketing messages (with separate opt-in)

6.2 Message Frequency and Charges

Message frequency varies based on your service level and training schedule. You may receive up to 10 messages per month for active participants. Standard message and data rates apply as determined by your wireless carrier.

6.3 Opt-Out Procedures

You may opt-out at any time by: (1) Texting "STOP" to any message from us, (2) Calling +1(347)644-4416, or (3) Emailing us. Text "HELP" for customer support. Opting out may affect your ability to receive important service-related communications.

7. CANCELLATION AND SCHEDULING

7.1 Session Cancellations

Participants must provide at least 24 hours' notice for session cancellations. Late cancellations or no-shows may result in forfeiture of the session without refund.

7.2 Company Cancellations

We reserve the right to cancel sessions due to weather, facility issues, or insufficient enrollment. Participants will receive full credit or refund for company-cancelled sessions.

8. LIABILITY AND ASSUMPTION OF RISK

8.1 Assumption of Risk

Participation in athletic activities involves inherent risks of injury. By participating, you acknowledge and assume all risks associated with basketball training and related activities.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FARBEYONDGIFTED LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

9. MEDIA RELEASE AND INTELLECTUAL PROPERTY

9.1 Photography and Video Consent

By participating in our services, you grant FarBeyondGifted LLC the right to photograph, videotape, and record your participation for promotional, educational, and marketing purposes. You waive any right to compensation for such use.

9.2 Intellectual Property Rights

All training methods, materials, and content provided by FarBeyondGifted LLC are proprietary and protected by intellectual property laws. Unauthorized reproduction or distribution is prohibited.

10. CODE OF CONDUCT

All participants must:

• Treat all participants, coaches, and staff with respect
• Follow all safety guidelines and instructions
• Arrive on time and prepared for training
• Maintain appropriate language and behavior
• Respect facility rules and equipment

Violation of our code of conduct may result in suspension or termination of services without refund.

11. PRIVACY AND DATA PROTECTION

Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms by reference, for information about how we collect, use, and protect your personal information.

12. FORCE MAJEURE

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, or public health emergencies.

13. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Material changes will be communicated via email, SMS (if opted in), or website notice at least 30 days before taking effect. Continued use of our services constitutes acceptance of modified Terms.

14. DISPUTE RESOLUTION

14.1 Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

14.2 Dispute Resolution Process

Any disputes shall first be addressed through good faith negotiation. If unresolved, disputes shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in New York.
